1. Acceptance of Terms

By downloading, installing, or using Pancrass ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Pancrass ("we," "our," or "us").

2. Medical Disclaimer

2.1 Not Medical Advice

Pancrass does not provide medical advice, diagnosis, or treatment. All content, features, and information provided by the App are for general informational purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment.

2.2 No Dosing Recommendations

Pancrass does not recommend, calculate, or suggest insulin doses or any medication dosing. Any numerical values, patterns, or insights displayed are purely informational. You must never use this information to determine medication dosages.

2.3 Consult Healthcare Providers

Always seek the advice of your physician, endocrinologist, or other qualified healthcare provider with any questions you may have regarding your diabetes management, blood glucose levels, insulin therapy, or any medical condition.

2.4 Emergency Situations

If you are experiencing a medical emergency, call emergency services immediately. Do not rely on this app during hypoglycemic or hyperglycemic emergencies. This app is not designed for emergency use.

2.5 Data Accuracy

While we strive to display accurate information from connected devices (CGMs, fitness trackers), we cannot guarantee the accuracy, completeness, or timeliness of any data. Sensor readings can be delayed, inaccurate, or malfunction. Always verify critical readings with a blood glucose meter.

2.6 AI-Generated Content

Insights generated by AI features are based on pattern recognition and statistical analysis. They are not medical recommendations. AI can make errors, miss important context, and should never be trusted for medical decisions.

3. User Responsibilities

By using Pancrass, you agree to:

• Use the App only for personal, non-commercial purposes
• Provide accurate information when setting up your profile
• Maintain the security of your account credentials
• Not rely solely on the App for diabetes management
• Continue regular consultations with your healthcare team
• Verify critical glucose readings with approved medical devices
• Report any bugs, errors, or concerning behavior to us
• Keep your connected devices (CGM, fitness trackers) properly maintained

4. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Use the App to collect data about other users
• Redistribute, sell, or sublicense the App
• Use the App in any way that could damage, disable, or impair it
• Use automated systems or software to extract data from the App
• Misrepresent your identity or affiliation

5. Intellectual Property

The App, including all content, features, and functionality, is owned by Pancrass and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your health data remains yours. We claim no ownership over any data you input or generate through the App.

6. Third-Party Services

The App integrates with third-party services (Dexcom, Oura, Apple HealthKit, OpenAI, Anthropic). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

7. App Personality and Content

Pancrass features a sarcastic and occasionally vulgar personality. This is intentional and designed to provide a different kind of diabetes management experience. By using the App, you acknowledge that:

• The App may use strong language and sarcastic humor
• Personality settings can be adjusted but may not eliminate all colorful language
• The tone is meant to be motivational and relatable, not offensive
• If you find the content objectionable, you should discontinue use

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• WE DO NOT WARRANT that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• WE ARE NOT LIABLE for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, health, or other intangible losses, resulting from:
  • Your use or inability to use the App
  • Any errors or omissions in content
  • Unauthorized access to your data
  • Any medical decisions made based on App information
  • Device or sensor malfunctions
  • Third-party service failures
• OUR TOTAL LIABILITY shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pancrass and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any medical decisions you make based on App information

10. Termination

10.1 By You

You may stop using the App at any time. Delete the App to remove it from your device.

10.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Behavior harmful to other users or third parties
• Extended periods of inactivity
• Requests by law enforcement

10.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, and indemnification.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pancrass regarding the App and supersede any prior agreements.
